Right of Withdrawal

Consumers are entitled to a right of withdrawal in accordance with the following provisions. A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.

A. Withdrawal Policy

Right of Withdrawal

You have the right to withdraw from this contract within fourteen (14) days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party designated by you who is not the carrier, took possession of the last item of the goods.

To exercise your right of withdrawal, you must inform us:

by means of a clear statement (e.g. by letter or e-mail) of your decision to withdraw from this contract. You may use the attached model withdrawal form, although this is not mandatory.

To meet the withdrawal deadline, it is sufficient that you send your notification concerning the exercise of your right of withdrawal before the withdrawal period has expired.

Exclusion of the Right of Withdrawal

According to Section 312g (2) of the German Civil Code (BGB), the right of withdrawal does not apply in particular to contracts for the supply of:

  • goods that are made to the consumer's specifications or are clearly personalized;

  • goods that are liable to deteriorate rapidly or whose expiry date would quickly be exceeded.

Our plants are living natural products. Depending on the species, they may change in appearance or lose quality within a short period due to their biological characteristics, transportation, temperature, humidity, or other environmental influences. Where the legal requirements of Section 312g (2) No. 2 BGB are met, no right of withdrawal exists.

Early Expiry of the Right of Withdrawal

The right of withdrawal expires prematurely for contracts concerning:

  • the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;

  • the supply of goods which, after delivery, have been inseparably mixed with other goods due to their nature.

 

Effects of Withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including the costs of standard delivery (except for any additional costs arising from your choice of a delivery method other than the least expensive standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we receive your notice of withdrawal.

We will use the same means of payment that you used for the original transaction unless expressly agreed otherwise. You will not incur any fees as a result of the reimbursement.

We may withhold reimbursement until we have received the returned goods or until you have provided proof that you have returned the goods, whichever occurs first.

You must return the goods to us without undue delay and, in any event, no later than fourteen days from the day on which you notify us of your withdrawal. The deadline is met if you send the goods before the fourteen-day period has expired.

You are responsible for the direct costs of returning the goods.

You are only liable for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics, and functioning of the goods.

General Information

  1. Please handle the goods with care and avoid damage or contamination.

  2. Whenever possible, return the goods in their original packaging together with all accessories and packaging materials. If the original packaging is no longer available, please use suitable packaging to ensure adequate protection during transport.

  3. Please do not return goods with postage unpaid.

  4. The above recommendations are not a prerequisite for the effective exercise of your right of withdrawal.

Notice regarding live plants

Live plants are natural products. Variations in size, number of leaves, growth habit, variegation, coloration, or root development do not constitute a defect, provided that the delivered plant corresponds to the ordered variety.

Your statutory warranty rights remain unaffected.
